The Colombian Constitution and legislation recognize the freedom of education and the right to create private schools with their own ideology. However, in the Constitutional Court case law the rights of students or teachers have prevailed over the rights of the school ideologically committed. The article stresses the importance of balancing the various rights and interests at stake.
